Introduction

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Flur Technologies Nigeria Limited ("Flur," "we," "us," or "our."). These Terms govern your access to and use of Flur's website, mobile applications ("App"), and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. These Terms apply to all visitors, users, merchants, and others who access or use the Service.

Definitions

Flur

Refers to Flur Technologies Nigeria Limited and its affiliates.

User

An individual who registers an account to use personal services.

Merchant

A business entity or individual using Flur for commercial transactions.

Wallet

A digital store of value linked to your account on the Platform.

Family & Group Wallet

A sub-wallet feature allowing multiple users access.

SecurePass

Flur's proprietary authentication tool for fast but secure transactions.

Partners

Third-party financial institutions, banks, and payment processors integrated with Flur.

Services we provide

Wallet & Payments

A secure and reliable e-wallet for storing funds, making transfers, and paying bills seamlessly.

Family & Group

Collaborative finance tools for families, couples, and groups to manage shared expenses.

Merchant Tools

POS systems, invoicing, and payment collection tools designed for Nigerian businesses.

APIs & Integrations

Developer tools for integrating Flur payment capabilities into third-party applications.

Your Obligations

You must be at least 18 years old and competent to contract. You agree to use the Platform, adhere to specific operational standards. Failure to comply may result in account suspension or breach of terms.

Accurate Information & KYC

You must provide true, accurate, and current information, including valid BVN and ID verification.

Security of Credentials

You are responsible for keeping your PIN, passwords, and device access confidential and safe.

Lawful Use

You agree not to use the platform for fraud, money laundering, or any other activity prohibited by Nigerian law.

Respect for Limits

You must respect transaction limits and not attempt to circumvent any feature restrictions.

Payments & Wallet

Flur is not a bank. We partner with licensed financial institutions (including Access Wallet and VFD Bank) to hold funds and process transactions. When you hold a balance in your Flur wallet, those funds are held in a pooled account by our partners.

Transactions made through the platform are generally final. However, we reserve the right to reverse transactions that are erroneous, fraudulent, or unauthorised. Refunds are processed according to our Refund Policy and the policies of our partners.

You acknowledge that transfer times may vary depending on the banking network and third-party processors.

Intellectual Property

Flur's IP

All rights, title, and interest in and to the Platform, including our website, application's logos, designs, text, graphics, and code, are the exclusive property of Flur and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform strictly in accordance with these Terms.

Your Content

By uploading content (such as profile photos or group descriptions) to Flur, you grant us a worldwide, royalty-free license to use, store, and display that content for the purpose of providing the service. You retain ownership of your content and are responsible for its legality.

Third-Party Services & Partners

Flur relies on third-party providers for certain services, including banking, payment processing, and identity verification. Your use of these features may be subject to the terms and conditions of these partners.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
  • ANY CONTENT OBTAINED FROM THE SERVICE.
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Indemnity

You agree to indemnify and hold harmless Flur and its officers, directors, employees, and agents from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with: (i) your use of the Service or services or goods obtained through your use of the service; (ii) your breach or violation of any of these Terms; (iii) Flur's use of your User Content; or (iv) your violation of the rights of any third party, including Third Party Providers.

Term & Termination

Effectiveness

These terms come into effect upon your creation of an account or use of the Platform and remain in effect until terminated.

Termination by Flur

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Termination by Us

You may end your agreement at any time by closing your account and discontinuing use of the Service.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through amicable negotiation. If negotiation fails, the dispute shall be referred to binding arbitration in Lagos, Nigeria, in accordance with the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria 2004.
